Photoburst turns photos and video clips you select into an interactive album (a "burst") with music, and an optional title and map flyover intro (built from locations you type in — we do not read location data from your photos). You can preview a burst, save it to your account, and share it with anyone, in or outside the app: recipients don't need an account or an install to watch — the link plays in their browser — and they can install Photoburst for the full experience.
You can create and preview bursts without an account. Saving or sharing requires signing in — with Apple, Google, or an email address and password. You are responsible for activity under your account. You must be at least 16 years old, or have a parent or guardian's consent.
Purchases are processed by our payment partner acting as merchant of record — they are the seller of the subscription, handle payment data, applicable taxes, invoices, and refunds under their checkout terms, which are shown at purchase. Photoburst — the app, its design, code, and the Photoburst name — belongs to CTINX SA. Your use of the service doesn't grant you any rights in it beyond these terms, and you may not copy, modify, reverse engineer, or build derivative services from it, except where law expressly permits.
Photoburst is under active development. Features may change, and availability is not guaranteed. We will communicate material changes that affect paid plans, and if we ever discontinue the service we will give Keep Forever subscribers reasonable notice to retrieve their content.
Don't abuse the service: no attempts to disrupt or overload it, no automated scraping of shared bursts, no reselling access, no circumventing plan limits. We may apply technical limits to protect the service for everyone.
You can stop using Photoburst and request account deletion at any time. We may suspend or end accounts that violate these terms. We may also decline, suspend, or end access where we consider it necessary — for legal, security, or operational reasons, at our discretion. Where reasonably possible, and always for accounts in good standing, we'll give you notice so you can retrieve your content before access ends.
If a third party brings a claim against us arising from content you uploaded or shared, or from your breach of these terms, you agree to indemnify and hold CTINX SA harmless from the resulting damages, costs, and reasonable legal fees.
To the extent permitted by law, Photoburst is provided "as is", and our liability is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect damages, for content created or shared by users, or for loss of content where you no longer hold your originals (see section 7).
These terms are governed by Swiss law, excluding its conflict-of-law rules. Place of jurisdiction is Geneva, Switzerland.
If any provision of these terms is found invalid or unenforceable, the remaining provisions stay in full effect, and the invalid provision is replaced by a valid one that comes closest to its intent.
We may update these terms; the "Last updated" date reflects the current version. If a change materially reduces your rights, we'll announce it in the app before it takes effect. Continued use after an update constitutes acceptance.
