Terms of Use

1. Who we are

Photoburst is operated by CTINX SA, Switzerland ("Photoburst", "we", "us"). Contact: hello@photoburst.app. By using Photoburst you agree to these terms.

2. What Photoburst does

Photoburst turns photos and video clips you select into an interactive album (a "burst") with music, and an optional title and map flyover intro (built from locations you type in — we do not read location data from your photos). You can preview a burst, save it to your account, and share it with anyone, in or outside the app: recipients don't need an account or an install to watch — the link plays in their browser — and they can install Photoburst for the full experience.

3. Your account

You can create and preview bursts without an account. Saving or sharing requires signing in — with Apple, Google, or an email address and password. You are responsible for activity under your account. You must be at least 16 years old, or have a parent or guardian's consent.

4. Free trial and plans

• Your first 14 days are a free trial with everything included. No payment details are required, and the trial never turns into a paid subscription by itself — paying always requires you to actively subscribe. The trial is tied to your account and starts when you first save or share.
• After the trial, creating new bursts requires a paid plan. Bursts you already created remain viewable and shareable for their normal lifetime, and viewing bursts you receive is always free.
• On the Photoburst plan, bursts expire 7 days after creation.
• On the Keep Forever plan, your bursts are retained for as long as your subscription is active, up to a fair-use limit of 1000 bursts. "Forever" describes the intent — no scheduled expiry — not a promise that outlives your subscription or the service itself; see sections 7 and 9.
• If your Keep Forever subscription lapses (cancellation or failed renewal), your content does not vanish abruptly: we notify you, and your bursts transition to the standard expiry rules with a grace period to re-subscribe or save your originals.
• Prices, taxes, billing period, and cancellation are shown at purchase. Subscriptions renew until cancelled; you can cancel anytime, effective at the end of the paid period.

5. Payments

Purchases are processed by our payment partner acting as merchant of record — they are the seller of the subscription, handle payment data, applicable taxes, invoices, and refunds under their checkout terms, which are shown at purchase. We never see or store your card details. Every purchase is covered by our 14-day money-back guarantee — see the Refund Policy.

6. Your content

• Your photos and videos remain yours. We claim no ownership, and we don't use your content for anything except delivering the service.
• You grant us the limited technical licence needed to store, process (resize, transcode, assemble bursts, generate flyovers), and deliver your content to the people you share it with. Nothing more.
• Bursts are created by their users: the person who creates and shares a burst is responsible for its content. We do not pre-review shared content.
• Only upload content you have the right to use, and share bursts that include other people only with their consent where required. Don't upload content that is illegal, infringes others' rights, or is abusive. We may remove such content and suspend accounts that violate this. Rights holders can send takedown notices to the contact address above.
• Music and sound provided inside Photoburst belongs to us or our licensors and may only be used within bursts created in the service — it may not be extracted or used elsewhere.
• When you share a burst, anyone who holds the link can view it and react to it — whether you sent it to them, someone forwarded it to them, or (however unlikely, since identifiers are long and random) someone guessed it. Links are never listed publicly — but share links as thoughtfully as you would the photos and videos themselves.

7. Deletion and expiry

• You can delete a burst at any time; deletion makes it unavailable to recipients immediately.
• Deleted bursts stay recoverable by you for 30 days, then are permanently erased.
• Expired content (per your plan) is likewise permanently removed after its recovery window. We show warnings before anything is permanently deleted — but you are responsible for keeping the originals of anything you upload.

8. Our software and brand

Photoburst — the app, its design, code, and the Photoburst name — belongs to CTINX SA. Your use of the service doesn't grant you any rights in it beyond these terms, and you may not copy, modify, reverse engineer, or build derivative services from it, except where law expressly permits.

9. Service changes and availability

Photoburst is under active development. Features may change, and availability is not guaranteed. We will communicate material changes that affect paid plans, and if we ever discontinue the service we will give Keep Forever subscribers reasonable notice to retrieve their content.

10. Fair use of the service

Don't abuse the service: no attempts to disrupt or overload it, no automated scraping of shared bursts, no reselling access, no circumventing plan limits. We may apply technical limits to protect the service for everyone.

11. Suspension and termination

You can stop using Photoburst and request account deletion at any time. We may suspend or end accounts that violate these terms. We may also decline, suspend, or end access where we consider it necessary — for legal, security, or operational reasons, at our discretion. Where reasonably possible, and always for accounts in good standing, we'll give you notice so you can retrieve your content before access ends.

12. Indemnification

If a third party brings a claim against us arising from content you uploaded or shared, or from your breach of these terms, you agree to indemnify and hold CTINX SA harmless from the resulting damages, costs, and reasonable legal fees.

13. Liability

To the extent permitted by law, Photoburst is provided "as is", and our liability is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect damages, for content created or shared by users, or for loss of content where you no longer hold your originals (see section 7).

14. Governing law

These terms are governed by Swiss law, excluding its conflict-of-law rules. Place of jurisdiction is Geneva, Switzerland.

15. Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions stay in full effect, and the invalid provision is replaced by a valid one that comes closest to its intent.

16. Changes to these terms

We may update these terms; the "Last updated" date reflects the current version. If a change materially reduces your rights, we'll announce it in the app before it takes effect. Continued use after an update constitutes acceptance.
